Our weekly project for this course will cover several important aspects of strategic management in healthcare, although there are many, many aspects we will not cover in this introductory course. The final project will be, as the CEO/leader of an acute care hospital, your development of a strategic plan for an acute care hospital. This week, your first project introduces you to several very important parts of leaders and their teams' strategies for equitable, quality care and success as an organization as a whole. Privacy laws and ethical decision-making will be researched and addressed. Mr. Jackson is the CEO (chief executive officer) of a 400-bed acute care hospital in Oregon. He has been in his position for 10 years and is well-respected by his team of employees, physicians, as well as by community leaders. Dr. Lawson, one of the general surgeons at the hospital, enters Mr. Jackson’s office after a hectic day in the operating room. Dr. Lawson is concerned because during lunch in the cafeteria, he overheard 2 family practitioners (FPs) discussing a specific patient’s name and condition in front of others at the table, as well as potentially people close enough to hear the conversation. Dr. Lawson is well aware of HIPAA regulations, which prompted his report to the CEO. Dr. Lawson knows that if the CEO confronts the FPs, they will know who reported the incident since Dr. Lawson mentioned HIPAA laws quietly to one of the FPs during the violation. Dr. Lawson also knows that his income could be negatively affected if the FPs were to be offended by his report to the CEO, since they refer patients to him. Dr. Lawson requests anonymity. The hospital CEO has a decision to make that could possibly damage his relationships with the 3 physicians involved in the HIPAA violation. If he discusses the incident with the 2 FPs, they might be offended and not support Dr. Lawson or himself as CEO going forward even though they know they were violating HIPAA regulations. He thinks to himself that perhaps due to Dr. Lawson’s actions, the FPs will not let such an incident occur again. Ethical decision-making can be difficult at times. HIPAA is a set of federal laws which, if not complied with, can result in severe penalties. The CEO is ultimately responsible for protecting all stakeholders in an organization, including board members, physicians, staff members and more. He is also responsible for protecting patients and their privacy, by law. Assignment: In 1-2 pages, answer the following questions. Support your answers with credible, current research citing your sources in APA format. After mentioning HIPAA to one of the FPs in violation, did Dr. Lawson then do the right, ethical thing by reporting the incident to the CEO? Explain your viewpoints. What other appropriate actions might Dr. Lawson have taken instead? If you were in the CEO's position, how might you handle the report? Is is necessary for him to consult a diverse team on the hospital Ethics Committee to assist him with his decisions? How might an organization's Corporate Compliance Officer be of assistance?
