Subsequently, the individual files a civil action against Officer Dolan under Section 1983 alleging that under color of law, she violated his First Amendment right to privacy. Officer Dolan moves to dismiss the lawsuit and files a statement under penalty of perjury informing that at the Newcadia Police she never received training about GPS tracking devices in light of Jones. More so, in only one week of work in Ft Worth, she cannot be expected to learn such legal doctrine and apply the same.
