Project Summary: 1. Case references: World Trade Organization and Environment and International Trade The WTO, via provisions initially incorporated into the GATT (General Agreement on Tariffs and Trade), provides signatory countries the ability to restrict trade on the grounds of conservation of natural resources or human, animal or plant health. The case Environment and International Trade provides several instances in which countries tried to restrict trade based upon those grounds with varying success. The WTO also allows for regional as well as multilateral trade agreements, reviews trade agreement provisions to ensure those agreements meet rules established by WTO member countries, and, provides dispute settlement mechanisms to address cases arising from trade issues amongst member countries. Today there is a heightened global environmental consciousness. Reflecting upon the Tuna-Dolphin case, what arguments would you employ to justify the initial U.S. actions in restricting trade in efforts to convince the WTO Dispute Settlement Body to rule in favor of the U.S. restriction? Address this question within the context of issues presented in Chapters 3 through 6 and Module A. Please explain your answers fully.
